Terms of Sale and Use
1. General conditions
Harold-w.com is the online sales site belonging to Harold W. SA, a watch and jewellery store located at 20 rue du Mont-Blanc, 1201 Geneva, Switzerland. By accessing this website, the user accepts the terms of sales and use governing it, and declares having read and understood them.
Harold W. SA reserves the right to modify its website or to discontinue the services offered by it, with or without notice. The user accepts that Harold W. SA is not liable for any modification, suspension, or termination of services. Harold W. SA has no obligation to update its website. It is up to the user to consult it regularly to be informed of any changes.
The use of certain services on harold-w.com (after-sales service, products sold for third parties) is subject to special conditions. By making use of the services in question, the user agrees to comply with those conditions. In the event of any discrepancy, the special conditions prevail.
Any intervention by Harold W. SA, in particular in the context of its after-sales service, is payable by the user (shipping, insurance, import, export, etc.). Before sending or returning any item, the user will communicate detailed information and photographs of it. Items serviced or repaired by Harold W. SA are only returned to the owner upon complete payment of the invoiced amount.
2. Content and items
The content of the harold-w.com website is offered as is. It may not be used, reproduced, distributed, transmitted, broadcast, represented, sold, transferred, or otherwise capitalised upon in any way or for any other purpose than consultation and use on the website. Harold W. SA authorises limited, revocable, and non-exclusive access and use of its website by the user, in a private capacity and in accordance with these terms.
The user agrees not to violate any legal standard, or to use the harold-w.com website for any unlawful purpose; not to include any false, incomplete, or inaccurate information; not to introduce viruses or other programmes designed to damage, produce adverse effects, intercept, or counter any system, data, or personal information.
The items sold are described on the harold-w.com website at the time of the sale. Their characteristics and the photographs of them are provided in agreement with suppliers and are provided for information only. Harold W. SA does not guarantee the conformity of any item with its description or illustration.
Items are available on the harold-w.com website for the duration of the sale and depending on availability. If suppliers are unable to deliver the items requested by the user, Harold W. SA may at any time cancel the order and refund to the user any amount already paid.
3. Prices and shipping costs
The prices for items sold on Swiss territory are in Swiss francs, inclusive of VAT; VAT is deducted for items sent abroad. Shipping charges indicated in the “basket” section will be added to the sales price. Items are billed to the user’s address, but can be shipped to any other address provided when ordering.
With the exception of any special conditions specified when the order is confirmed, the estimated delivery time is 8 days for Switzerland and 30 days for orders shipped abroad. The shipping date indicated in the confirmation email is an estimate and does not engage the responsibility of Harold W. SA.
Harold W. SA is not responsible for delays or problems during delivery. Upon delivery of items to the post office or one of the two freight carriers presented on the harold-w.com website, the sale shall be considered validly executed and Harold W. SA shall be released of any liability.
4. Confirmation of the order
By clicking the button “confirm my order”, the user agrees to purchase the selected items. The sales contract is valid upon receipt of the confirmation email, subject to availability from suppliers.
The price of goods purchased on the harold-w.com website is due upon ordering. Payment via bank transfer, (UBS, Postfinance) or by credit card (PayPal) is only valid when the amount is credited to the account of Harold W. SA. The user’s invoice is saved and details of the order are sent via email.
The user can also pay for the order with purchase vouchers, which can be used on the harold-w.com website or in the store. Vouchers can not be exchanged, and any remaining value on vouchers cannot be given in cash. In the event of partial use of a voucher, the validity of the remaining value will be twelve months from the first purchase.
The user can cancel a purchase within seven days of receipt of the item, unless it is clearly indicated “not returnable”. Items must be returned in the condition received, in their original packaging, and with a return slip to the address indicated in the fist paragraph of these provisions.
Items sold new by Harold W. SA are in perfect condition; they must therefore be returned in the same condition. In case of return of an antique or collector’s item, it must be returned in the condition indicated in the description provided at the time of sale, mentioning any normal wear. Harold W. SA does not cover damage resulting from improper use.
For returns consistent with the above paragraphs, the amount paid by the user when purchasing the item will be refunded to his bank account or credit card.
6. Link to the harold-w.com website
If the user wishes to establish a link to the harold-w.com website, he expressly agrees to: (i) not have the website appear within another website; (ii) not create any association between the website and a third party; (iii) correctly attribute to Harold W. SA the website to which the link directs; and (iv) ensure that the link does not imply, implicitly or explicitly, that Harold W. SA approves, supports, or is responsible for the activity of any other website, company, or entity, and that the activities of Harold W. SA are not represented in any way that may damage its reputation.
The link to the harold-w.com website does not authorise the user to make use of any Harold W. SA content, name, logo, image, or brand without prior written consent. Harold W. SA reserves the right to demand that the user remove any links to its website, without having to justify its reasons.
7. Final provisions
The terms of sale and use of the harold-w.com website and the contractual relations between the user and Harold W. SA are governed by Swiss law. Any dispute related to these terms will be settled by the ordinary courts of Geneva.
